Scarmans is committed to safeguarding the privacy of our clients, third parties and visitors to our website.

This Privacy Policy is designed to tell you about our practices regarding collection, use, and disclosure of data and information that you may provide by using our services.

Who we are

Scarmans is the trading name of Scarmans Ltd and is incorporated in the UK with the registration number: 9703562. Our vat number is 224 0312 66.

Scarmans Ltd is authorised & regulated by the Solicitor’s Regulation Authority, SRA no:  624074.

Scarmans are also registered on the Information Commissioner's Register.

Collecting your personal Data & Information 

We may collect your personal data for a number of reasons, but in the main to represent your interests as a law firm. Various members of our team may collect the data, including lawyers, admin staff, our accounts team and those in the marketing department.

You may give us your identity, contact, transaction, profile, legally privileged documents and other data by visiting our offices, by visiting our website, by filling in forms and by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

  • Instruct us to act for you;
  • make an appointment;
  • subscribe to our service or publications;
  • request marketing to be sent to you;
  • enter into a contract for services or employment with us;
  • apply for a job vacancy with us;
  • give us some feedback.
As you interact with our website, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies.

Cookies allow us to distinguish you from other users of our website. This helps us to provide you with the best experience and also allows certain parts of our site to function correctly.

You are not required to provide any personal information on the public areas of this website or otherwise. However, you may choose to do so by completing the form on the ‘contact us’ section. Should you not provide us with your data, where it is requested, then it may not be possible to act for you and to represent your interests as a law firm.

We will not use your information for purposes that are not clear when you provide your details, and will not disclose it outside the firm, except to service providers acting on our behalf or in other very limited circumstances, for example, with your agreement or where we are legally obliged to do so.

Some of our web content includes buttons that allow visitors to share content easily with their online networks, using for example LinkedIn or Twitter. We do not control the use of these third-party cookies, as such you will need to consent to their private policies if re-directed to their websites and wish to use the same.

How we use your personal data

We may use your personal data for a number of reasons. These include:

  • to comply with the legal services in which Scarmans has been engaged;
  • to comply with client’s instructions and requirements;
  • so that we may comply with any legal obligations we have;
  • in order to comply with our duties and exercising our rights under a contract, in its performance with you;
  • to protect clients, employees and other individuals in maintaining their health,safety and welfare;
  • where you have consented to the processing of your personal data;
  • to comply with the law;
  • for accounting purposes;
  • to process payments;
  • promoting, marketing and advertising our services;
  • to improve the services we can offer you;
  • when liaising with your contacts, third parties, agents, opponents, courts, authorities, councils, prosecutors, Regulators, professional advisors, enforcement agencies on your behalf;
  • fulfilling our duties to clients, employees, directors, the authorities, professional advisors, enforcement agencies, regulatory bodies and shareholders.
We usually keep information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Further we have regulatory safeguards to keep client information for a period of 6 years, where instructed.

Your information may be shared with our marketing department. We do not share your details with any other party unless you have given your consent.

Our Marketing Practices

At this time, we do not operate any marketing practices and therefore your consent will be obtained prior to any marketing or when you have engaged our legal services by signing our retainer. To provide consent, it is expected that you would need to be at least16 to do so, otherwise parental consent would be required.

Sending personal data internationally

The majority of data is held in the EU, but in some circumstances we have to send data we receive from you overseas, in particular to the USA, outside of the European Economic Area (EEA). This is particular to cloud technology, or servers, where we hold your data on case management systems, storage facilities and cloud sharing platforms. In such circumstances we ensure that our third-party service providers are applying the laws of privacy by way of EEA Model Clauses, or other legally accepted safeguards, as applicable. The third-party service providers are trusted providers with high levels of data security and compliance in their own right. They use Microsoft Azure geo-redundant servers that backup the data in real-time across multiple geo-redundant locations across the US. By submitting your personal data, you agree to this transfer, storing or processing outside of the EEA. 

Confidentiality & Data Security

Scarmans acknowledges that the information you provide may be confidential. The firm will maintain the confidentiality of and protect your information in accordance with our normal procedures and all applicable laws.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We will notify you and any applicable regulator of a breach where we are legally required to do so.

We continue to use high levels of security to protect your personal data against loss, alteration or any other form of unlawful use. Where possible, your personal data will be encrypted and stored on high level security cloud servers. Where data is held on, or capable of being accessed by desktop, laptop, tablet computers and mobile phones, that equipment is password protected and encrypted.

We have in place, procedures to deal with any suspected breaches in your personal data and will notify you and our regulators of any such breaches where we are required to do so.

Your Rights

Under applicable data protection legislation, we must ensure that your personal information is accurate and up to date. Therefore, please advise us of any changes to your information.

You have a number of rights with regards to how your data is protected.

Under certain circumstances, you have the following rights under data protection laws in relation to your personal data:

  • to request access to your personal data;
  • to request rectification or erasure of your personal data;
  • to object to and restrict the processing of your personal data;
  • to request the transfer of your personal data;
  • to withdraw consent;
  • the right to be informed;
  • the right to complain;
  • the right to be forgotten;
  • the right not to be subject to automated decision making, including profiling.
By providing us with your information you will have the right to access and rectify your personal details. If you did wish to access your data, a subject access request (SAR), you shall have the right to view or receive a copy of the information in a commonly used format such as a pdf document or an e-mail.

If you wish to make a complaint or you wish to exercise any of the rights set out above, please contact us at gdpr@scarmans.co.uk. We will act promptly following any request, usually we will respond within a month of your request.

Any information which is processed by automated means and is purely required for the performance of a contract, may be transmitted to another data controller if you request it.

You may also have the right to ask for the processing of your personal data to be restricted or even erased.
